This Privacy Policy is intended to inform you about how Silverside Holdings Pty Ltd, trading as FlexiGardenFrames (ABN 76 625 375 635) ( “we”, “us”, “our”) will deal with your personal information, including via websites we control (“Websites”), incorporating any online store (“Store”) we may operate. If we collect or otherwise deal with your personal information, we will comply with applicable privacy laws in Australia including the Australian Privacy Principles contained within the Australian Privacy Act 1988 (Cth) (“the Privacy Act”) and to the extent applicable, the European Union (EU) General Data Protection Regulation (“GDPR”), where we process data related to identifiable UK or EU residents.
By providing your personal information to us you consent to the collection, use, transfer and disclosure of your information under the terms of this Privacy Policy. This Privacy Policy is to be read in conjunction with any Terms of Use document applicable to any of our Websites.
Collection and Use of Personal Information
We will collect personal information where it is knowingly and voluntarily submitted by you, in a variety of ways. We only use personal information for the purpose for which it was provided to us and related purposes, unless stated otherwise to you. Generally, this will be to enable us to fulfil the services that have been requested from us, to answer a query or to assess employment applications.

We may collect information from you, when you purchase from our Store or browse one of our Websites. We may also collect personal information in the context of your professional employment, to enable us to provide our services, or to fulfil a query or request. What information we collect depends upon the nature of our relationship with you, your employer and your/your employer’s clients or agencies. Importantly, in some circumstances if you do not provide the information that we request, you, or your employer, client or agency, may not be able to use or access some of our services, or receive a stated benefit or employment with us.
We may collect personal information from individuals from surveys they complete or if they provide it to us when they request a service, have a query or apply for employment with us. In addition, we may engage services of third parties (such as web hosts, survey companies or developers) to collect personal information from participants for various activities, on behalf of our clients or on our behalf, as the case may be. Collection will usually occur through websites, email, phone, fax, mail or in person and through the relevant party’s usual dealings with us.
The kinds of personal information that we may collect and hold includes:
• contact details including your first and last name, phone number, billing address, shipping address and email address;
• your computer’s internet protocol (IP) address;
• your credit card and payment details;
• history of purchases in our Store;
• employer details;
• agency and client details; and
• responses to survey/research questions.

• to process and fulfil an order;
• to help us learn about your browser and operating system so that we can tailor the our Websites or Store to your needs;
• where you have opted in, to send you emails about the Store, products, exclusive offers and other updates; and

‘Clickstream Information’
We may also from time to time receive and store certain automatic non-identifiable information relating to your use of, and behaviour on our Websites. This information is commonly referred to as "clickstream" information and it is not linked in any way to your email address, first name or last name. For example, we may record information such as the areas of the Website accessed by you, the time, date and URL of the pages requested by you, your browser software, device being used, connection type (Wi-Fi or cellular), network provider, screen resolution and/or the previous website that you have linked to the Websites from. The recording of such information enables us to identify the areas of our Websites that are most popular and to tailor the Website accordingly.
Disclosure and Storage of your Information
Information we collect from you will be stored securely either at our office, on a hard drive or on external cloud servers managed by third party service providers. Unless otherwise advised, personal information collected in Australia and from Australian residents will not be disclosed to entities located outside of Australia. Personal information collected from residents of countries other than Australia may be held in Australia and disclosed to clients, employers and/or suppliers in that relevant country (for example in New Zealand or the USA).
We take steps as are reasonable in the circumstances to protect personal information from misuse, interference, loss, unauthorised access, modification or disclosure. Personal information that is no longer required for the purpose for which it was collected will be de-identified or destroyed, subject to any applicable laws requiring retention of such information. EU and UK residents, you are able to request that we erase your data at any time.
When you place an order via the Store, we will need to disclose your personal information to companies who perform parts of the service delivery. This includes delivery companies, such as postal or courier partners, third party fulfilment contractors, merchant payment gateways for debit/credit card or PayPal payments, as well as Shopify which hosts the Store. We only share information which is absolutely necessary with those third parties that are involved in the processing and delivery of orders.
We may pass your information on to our client and/or to your employer, depending on the primary reason for collection and the services requested by the client in each case. We may also disclose personal information to, suppliers, service providers, contractors and agents, who we engage to supply certain services/goods for us (e.g. storage, web hosting, legal services, etc.). Where required by law, we may also disclose your personal information to the appropriate regulatory authorities.
In the event we coordinate the collection of personal information on behalf of a client (e.g. for a survey or research), that client’s privacy policy will also apply, and you must refer to that client’s privacy policy for further details on how the client collects, uses, stores and discloses your personal information.
Shopify
The Store is hosted on Shopify Inc (“Shopify”) who provide us with the online e-commerce platform that allows us to sell our products to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
If you choose a direct payment gateway to complete your purchase on the Store, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by the Store and its service providers. Third Party Services
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies on their websites so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. Once you leave our Websites or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Websites’ Terms of Use.
Cookies
A Cookie is a piece of information that our web server may send to your machine when you visit our Websites. The Cookie is stored on your machine, but does not identify you or give us any information about your computer. A Cookie helps us to recognise you when you re-visit our Websites and to co-ordinate your access to different pages on the Websites. With most internet browsers, you can erase Cookies from your computer hard drive, block all Cookies, or receive a warning before a Cookie is stored
Access to and correction of information and complaints process

Please note that we may deny access/correction of personal information to you to the extent that: (i) providing access/correction would pose a serious threat to the life or health of any individual or public health or safety; (ii) providing access/correction would have an unreasonable impact upon the privacy of other individuals; (iii) your request for access/correction is frivolous or vexatious; or (iv) it is otherwise appropriate for us to deny access/correction in accordance with the applicable privacy laws.
For UK and EU residents, you may also obtain a copy of your personal data on request and transfer this to another person or entity pursuant to your right of data portability, as well as request that your data be erased (right to be forgotten) to the extent that we can by law.
You should also contact us on the above details if you are concerned that there may have been a breach of your rights or any rights under the Privacy Act 1988 (Cth) or any other applicable privacy law or code. We take such matters very seriously and, we shall review your complaint and respond to any concerns promptly, usually within fourteen (14) working days.
